The State Government of AP, realizing the significance and importance of providing safe drinking water for the progress and well being of the citizens of Hyderabad, issued G.O.Ms.No. 111 M.A dated 08-03-1996, for protecting Himayat Sagar and Osman Sagar, which are the main sources of drinking water supply to Hyderabad & Secunderabad. The salient features of the G.O. are
*To prohibit polluting Industries, Major Hotels, Residential Colonies or other establishments that generate pollution, in the catchment of the
lakes up to 10 KMs from Full Tank Level (FTL) of the lakes. - Para 3 (i )
*Residential developments in residential use zone may be permitted with 60% of the total area kept as open spaces and roads in all layouts
in the villages of prohibited catchment area- Para 3 (i) (a)
*The land use of about 90 % of the area is classified as recreational and conservation use in the Master Plan. The HUDA should take action
for classification of this 90% of the area as Agriculture, which is inclusive of horticulture and floriculture Para 3 (i) (b)
*To restrict the FSI to 1: 0.5 in the catchment area. This measure will ensure that 90 % of the area remains under agriculture, as is the practice
now and ensure protection of the lakes- Para 3 (i) (c)
Supreme Court Judgment
The Supreme Court in its land-mark Judgment dated 01-12-2000 observed that having laid down the policy prohibiting certain activities within the catchment of the reservoirs, the government could not pass orders of exemption having dangerous potential, unmindful of the fate of Lakhs of citizens of the Twin Cities, to whom drinking water is supplied from these lakes. Also observed that such an order of exemption carelessly passed, ignoring the "Precautionary Principle" could be catastrophic.
Violations by Govt Agencies
There are a number of violations by the Govt Agencies with regard to the protection of the catchment area up to 10 Km from FTL of Himayat and Osman Sagars. The very salient ones are the CDFD Building abutting Osman Sagar Reservoir and the allotment of 2200 acres of Himayat Sagar catchment area for Hyderabad International Airport, The particulars of others are listed below:
Vattinagulapalli IT Parks & Layouts
The APIIC filed requisition, in October 2004, for alienation of Govt. Lands, previously earmarked for Formula-1 Race Course, in Sy.Nos. 117 & 127 to 132 measuring Ac.273.30 Gts, in Vattinagulapalli village ( within 10 Kms of prohibited catchment area ) in Rajendranagar Mandal of R.R District for establishment of IT Parks and took position of 120 Acers in Sy.No 132. The APIIC also filed requisitions for acquisition of Patta Lands to an extent of about 300 Acres in Vattinagulapalli for establishment of IT Parks.
While the proposals of IT Parks were being finalized, the APIIC seem to have realized that the lands are covered under G.O.111 and the matter was brought to the notice of the Chief Minister on 04-06-2005 and the proposal for development IT Parks in Vattinagulapalli was dropped, vide APIIC Letter No.2183/P.M (IPU) /APIIC /2005 dated 11-08-2005.. But again APIIC is reported to have registered around 100 acres of land in Vattinagulapalli Village to WIPRO, in July 2007, for setting up IT Park, in utter disregard to the provisions of G.O.111.
The Revenue Department issued G.O.Ms.No 522 dated 04-05-2006, in violation of the provisions; of G.O.111, allotting 33 acres of land in Sy.No. 132 of Vattinagulapalli village for development of 132 plots by HUDA and allotment to serving IAS Officers.
Change of Land Use
In accordance with the directions of AP High Court in W.P. 9386/07 the Dept of MA&UD, issued Memo No.14046/11/2007 dated 12-10-2007 directing HUDA and the District Collectors, of Ranga Reddy and Mahaboobnagar, to ensure that NO construction or development comes in prohibited catchment area of the Water Bodies, in violation of the provisions of G.O.111 and .to keep a strict vigil and take stringent action against the violators as per the law.
But unfortunately, the Dept of MA&UD itself issued G.O.M S. No.293 of 26-07-2011 changing the land-use of the Site in Sy.No. 696 in Janwada Village (one of 84 villages in prohibited catchment) of Sankarapalli Mandal in RR District (earlier in Sy.No 297 of Kollur Village of Medak District) to an extent of 33 Acers,, which is presently earmarked for Conservation use zone in the notified Master Plan, as Residential Use zone.
This change of land-use is being justified based on the ground, as on the date of issue of the G.O 111 (8-3-1996), the land was not in the revenue records of 84 villages, irrespective of the fact whether it falls within prohibited catchment area of 10 Km from FTL. or not
Allotment to Race Course Club
It is reported that the State Govt is contemplating allotment of 100 Acers of Govt land in SY No 510 of Kanakamamidi village (one of 84 villages) of Moinabad Mandal in R.R District to Race Course Club of Hyderabad, in addition to 20 Acers to Polo Association and 10 Acers to HUDA, which were already allotted.
It is a well known fact that a number of Educational Institutions, Resorts etc have come up during the last decade ,in addition to a large number of layout development activities taking place in the prohibited catchment area up to 10 Kms from FTL of the Water Bodies,
Conclusion
It is requested that directions issued by the Dept of MA&UD,vide Memo of 12-10-2007 be implemented strictly without granting any exemptions It is also requested that deterrent penal action be initiated against unauthorized developments that had come up after the Supreme Court Judgment and the officials responsible for the same
The HMDA may please be directed to take action for classification of 90% of the catchment area, in accordance with Para 3 ( I) (b) of G.O.111

I could not understand the zoning system properly.. I can see in hmda map lot of area marked in green as conservation and bio/conservation zone. Is there a residential use zone within that green zone? Also confused with 40% and 90% rules what is allowed where?
I have come across plots in Vattinagulapally (hmda show it in conservation zone), and the land agents say one can build houses upto 30% of your plot. Is that true? I could not locate clear rules reg this anywhere.

Thank You Mahesh.The entire catchment area up to 10KM from FTL of Himayat and Osman Sagars is notified as Bio Conservation Zone,90 % of which is classified as Agriculture, inclusive of horticulture and Flori-culture.Vattinagulapalli village falls under this zone.

Sorry, Mr.Bhupal Reddy, I will not be able to provide the particulars of the Survey Numbers of the lands covered by the prohibited catchment area up to 10Kms from FTL. The Prohibited catchment area includes 84 villages and the entire area falling under these villages is covered. The particulars of Survey Numbers can be obtained from respective village Revenue Records.

But if you are planning to build a house for your self in the plot, I presume, you can be permitted to build one subject to FSI 1:0.5 and G+1 and leaving 60% of the are as open space and subject to approval by Town & Country Planning Dept or HMDA.
If you are refused permission, you can question the construction of buildings next door to you in utter disregard and violation of the provisions of G.O.111.If there is no proper response, you can approach AP High Court questioning the rationale behind the discrimination / refusal .

As FSI restriction of 1:0.5 in the residential use zone of catchment area is meant to ensure that 90% of of the total catchment area remains as Conservation area, it should be made applicable to 40 % of the plot in residential use zone

The owner is ready to sell the land below the govt. value. could u pls suggest me whether i should go ahead or not. This layout is registered in the year 1997. If u want more details, ready to provide.
One more issue is - This layout is just beside to ORR service road. At present there is no connectivity to that service road. But builder guaranteeing that after registration of land, I will get the permission from concern authority. Could u pls guide me in this aspect. unable to decide on this. Pls give me ur suggestion as soon as possible.
Please be careful, before you stake your money for buying a plot in Vattinagulapalli layout as it falls within 10 Kms of FTL of Osman Sagar as per G.O.111. HMDA stipulated no developments to take place within one KM of ORR without prior approval of HMDA. Please check from HMDA.

Please check, before you buy plots from DLF layout, whether the layout falls within the the prohibited area, as per G.O.111 and the layout has the approval of Hyderabad Metropolitan Development Authority (HMDA).

ReplyDeleteI have agriculture land near Ramanjapur village in shamshabad mandal. It is 16 KM from shamshabad bus stand and 20km away from airport towards shabad road.
This land is under G.O 111 and HADA area. And this is the last village and 10km away from FTL Himayatsagar. I am planning to do 1000 Sq.yrds (9 Guntas) as Farm house plot. This land is not converted as commercial land. I want to get clear on few points if you can help me.
1. can i do farm house plot with 1000 Sq.yrds each?
2. what could be the construction area in that each plot? It could be around 30 or 40% in 1000 sq.yrds plot?
3. If this land is not converted as commercial land I have to get register according to Agriculture land rate for 9 guntas. But in Sub register office they are taking as per yard basis as commercial value. Other wise they are not doing registration.
How is it benefited/loss to the person who going to buy the land.

ReplyDeleteIn your agriculture land in the prohibited area you may have one Farmhouse basically meant to cater for the agricultural operations, but you are not permitted to develop Farmhouse Plots.
The layouts are permitted in the villages of catchment area , with prior approval of HMDA, subject to 60% of the total area of the layout is kept as open space and roads, with the restriction of FSI 1:0.5, ensuring that 90% of the prohibited area remains under agriculture.
There is no way to make any sensible person to buy the plots in the prohibited area , as per G.O.111.

When I was on an overseas assignment, I bought a farmhouse plot measuring 1000 Sq.Yards in Moinabad Opposite to Bhakar Medical college.
The very reason for buying this plot was to build a small house with a good garden (this was my dream) I had gone through your replies to several persons you are saying 60% of the plot and 90 % of the plot (FSI). My question here is Can I build 100 Sq. Yards house and leave 900 Sq.YARDS for the garden?

As I have been repeatedly saying, the purpose of GO.111 is to ensure that 90% of the land in the prohibited catchment area is kept as conservation area by restricting the use for agriculture / horticulture purpose only. The development of Farmhouse Plots goes against the very spirit of G.o.111. The farmhouses are permitted in the farms, basically meant to cater for the agricultural operations. Please check if the Farmhouse Plot bought by you is in the approved layout of HUDA/HMDA ?

2) It is a Gram panchayat approved lay out.
3)If the government authorities do not permit a house construction in that area, then I can very well construct a farm house and reside in that. I do not think any technical specifications were given by the so called Govt. authorities as such for the farm houses.
Or any chance of amendment in 111 GO ?
Unfortunately all the rules are for those who follow, and those who violate all the rules, no questions and no objections from government side.

ReplyDeleteCan you educate me about 10 Km radius.Gandipet and Himayatsagar are situated in Upper stream where rain water course flows to the reservoirs.Where as down stream villages under vattinagulapalli, rain water will not flow to the reservoirs located in upper area.How can it is justifiable to restrict Financial district areas.I do not know whose vision of mentioning 10 Km radius which is not on a plain surface.From Gandipet towards Vattinagulapalli several hills are there.Rain water from Financial district cannot reach Gandipet reservoir.You can observe this while travelling from Gandipet to Mehdipatnam via Narsingi,Financial district.Even Musi river flows towards city and not from the city.

ReplyDeleteThe G.O.111 stipulates prohibition of polluting activities in the catchment area of the Water Bodies up to 10 Kms from Full Tank Level (FTL)and not 10 KM Radius. The villages Vattinagulapalle, Khanapur, Gungurthy and Janwada are part of 84 villages identified in the prohibited catchment area.
The ORR was aligned along Himayat Sagar bund and cutting across the prohibited catchment area of Osman Sagar between Vattinagulapalle and Khanapur in utter disregard and violation of the provisions of G.O.111 and Supreme Court directive dated 1 st December 2000.
After formation of ORR one may get the wrong impression that Vattinagulapalle is down stream, which is not correct. The villages down stream are Nanakramguda, Poppalaguda, Narsing, Kokapet, Gopannapalle etc.
G.O.111 prohibits polluting industries (not polluting activities)within 10 Km radius (ie both on upstream and down stream sides of the water bodies) to prevent acidification of water in the lakes due to Air Pollution, which may now happen due to vehicular emissions from the ORR, if adequate precautions are not taken well in time.

Thank you Mr.Rao for visiting the Blog.As I am not aware of the exact location of CSK Prestige County,it may not be possible to confirm if it is under the prohibited area as per G.O.111.All developments within one KM from ORR need approval of HMDA, whether they are covered by G.O.111 or not.

DeleteIt comes under Rallaguda village (Rallaguda is a small village in Shamshabad Mandal in Rangareddi District in Andhra Pradesh State).
I am not sure whether it is a one KM from ORR.I had asked whether it is a HMDA approved or not but they are claiming that as it comes under gram panchyat approval is not required, also bcz of panchayat layout bank loan is not eligible.

The Rallaguda village is not one of the 84 prohibited villages listed in G.O.111.It may be a hamlet forming part of a Grama Panchayat. Some of the villages listed near Shamshabad are Ootapalli, Tondapalli,Gandiguda, Peddashapur, Kanakamamidi etc

The layout is a Panchayat approved layout and all the plots are of 1000/500 yards. I liked one of the 500 yds plots and wondering if I will be able to build a house in it? when I spoke to the land owner he mentioned that we can get the Panchayat approval and build a house (G+1) in 200 yards and the rest of the land should be open, I will be happy if this is true and would go ahead. Would you please help me in clarifying this to me? will I be able to do so? Would the Panchayat approval be enough?

The relevant extract from the Govt Memo is reproduced below for your info
"Accordingly, Government hereby instruct all the concerned authorities of Panchayat Raj & Rural Development Department, Revenue Department, Municipal Administration & Urban Development Department, Industries & Commerce Department, Greater Hyderabad Municipal Corporation, Hyderabad Urban Development Authority, Cyberabad Development Authority, Hyderabad Airport Development Authority, Hyderabad Metro Water Supply & Sewerage Board, Director of Town and Country Planning, A.P. Housing Board and other functional bodies which are associated with regulating the construction and development activity within the catchment area of Himayat Sagar and Osman Sagar Lakes not to allow any construction, layout and non-agriculture development activity within the upstream area of Himayat Sagar and Osman Sagar Lakes in tune with G.O.Ms.No. 111 M.A dt. 8-3-1996".
"Now that this entire catchment of the two water bodies falls within the jurisdiction of recently expanded Hyderabad Urban Development Authority area, the Vice Chairman, Hyderabad Urban Development Authority, the Collector, Ranga Reddy District, and the Collector, Mahaboobnagar District shall ensure that no construction or development comes in violation of the above said G.O. They shall keep a strict vigil and take stringent action against the violators as per the law".
"The Collectors, Ranga Reddy and Mahaboobnagar Districts, shall issue directions to all Gram Panchayats falling within the catchment area of the lakes not to issue any layout or building permissions in violation of the provisions of G.O.Ms.No. 111, dated. 08.03.1996".
The reported Panchayat approved layout with plots of 1000/500 yards in Pedda Mangalaram village Panchayat amounts to be illegal and unauthorized.
If every plot has 40% of built up area, how do we ensure 90% of the prohibited catchment area, under conservation area ie for agriculture use only.
My advice is, do not go in for a plot in prohibited catchment area as per G.O.111, if you want to be a Law-Abiding Citizen, which may not make you materially rich. The non-compliance of Law is the order of the day and a High-Profit Business these days.

Please check with MRO / Tasildar of the Mandal concerned regarding the land use status of the property as per Revenue Records, before you actually buy it.

The village Raviryala does not seem to be in the list of 84 villages identified in the prohibited catchment area of the water bodies as per G.O.111.The mention of Mandal under which the village falls, helps in identifying the location. However, please check up from the MRO of the concerned Mandal that the village is not covered by by G.O.111.

But the SRO office people are insisting that i pay govt rate of Rs.7000 per sq yard. how can the govt fix 7000 as govt value when construction is not allowed. As per G.O.111, the village Bhulkapur of Shankarapally Mandal of RR District is not one of the 84 prohibited Villages identified in the catchment of the Water Bodies. Janwada of Shankarapally Mandal, is the only village listed in the 84 prohibited villages in the catchment area.

Thank you Sharma for visiting the Blog. There seems to be some confusion about Rallaguda. If it is a Hamlet of Shamshabad Village, it is very much covered by the prohibited area as per G.O.111.Moreover if CSK Prestige County is within 1 Km from ORR , whether it is covered by G.O.111 or not, no development can take place without prior approval of HMDA.
DeletePlease approach HMDA to get the information under RTI, whether CSK has got prior approval for the project or not. Without getting this confirmation, please do not venture to buy the property in this project or any other one.
Obviously, Canara Bank has not done adequate home work before dishing out the loans for property in CSK Project. After all it is you, who is going to loose the money, if it is found to be

The conversion of Agriculture land for non agricultural purposes, in prohibited catchment area is not permitted. Even in other areas the conversion of agriculture land for other purposes is not normally permitted without following the directions of Hon'ble AP High Court in its Order dated 07-08-2012 in W.P. No.24342 of 2012.Moreover Village Panchayat may not the competent authority to give approval for the layouts that too in prohibited catchment area
Please do not venture to acquire the property in a lay out which appears to be in violation of all norms and rules.

I appreciate the home work done by you Santosh.The earmarking of area as Conservation Zone is not restricted to the prohibited area as per G.o.111.The HMDA while finalizing the Master Plan earmarks the land under different uses (zones)- Residential, Commercial, Industrial, Public Services, Water Bodies,Forests, Conservation etc Zones.

The Conservation zone generally covers the land earmarked for Agricultural, Hills, Recreation, Open spaces etc. The reduction of Conservation Zone by indiscriminate change of land-use earmarked in the Master Plan coupled with unauthorized changes of land use, is going to adversely affect the quality of life, with deteriorating Air Quality, increasing Temperatures of Heat-Islands, increasing Storm Water Runoff & consequent flooding etc With the reduction of agriculture land, there is already scarcity of locally grown seasonal vegetables, fruits, flowers etc, as result of which their prices are going up, increasing the cost of living and making the life of common city dweller more and more difficult
Change of Land Use
CAG in its report for the year ended 31 st March 2010, observed that approvals of change of Land-Use given on a case to case basis, conferring undue benefits to the land owners, thus violating the Sanctity of the Master Plan.
Conversion of Agriculture Land
The procedure laid down by the Hon’ble AP High Court Order dated 7-8-2012 in WP No. 24342/2012, in respect of conversion of Land-Use from Agriculture to Non-Agricultural purposes under AP Agricultural Land (Conversion for Non-Agricultural Purposes) Act, 2006 is to be strictly followed by the District Administrations. The conversions made routinely are considered to be illegal and are liable to be cancelled.
Advise
Please check that the land under reference has been authorized for the change of land use by following the due process and the layout has the approval of HMDA.

You have to cross check with HMDA regarding the permission for the change of land use stipulated in the Master Plan and the permissions required for the gated communities.

Ramarao garu, really appreciate your contribution and time for the same. One thing I fail to understand is as a community we are all being fooled by the leaders. We just follow what is in books and spending so much time. So need your help to first understand how is the 10KM decided from the lakes, what is center of Lake? Who decided what are villages in GO111 and what is the basis for it. We know even this is done by the same political parties. If you see they say just' Gopannapalli is residential and Vattinagulapally is not, Kokapet is fine', this is what I say blindly following books/theory. If we see google map, we realize so many residential and IT areas just adjusent to Osman Sagar??? Journalist Colony is Huda approved, but all other are in GO111 because, Name of village suddenly changes or the Survey numbers.

With regard to the area covered by G.O.111, the AP Govt constituted the Expert Committee to study the water inflows into Himayat and Osman Sagars and to recommend the measures to prevent water pollution so as to ensure clean and and safe drinking water to the citizens of Hyderabad. The committee submitted the interim report based on which some restrictions were imposed in the catchment area. After the Final Report of the Expert Committee was received, the G.O.111 was issued.

All Water Bodies have demarcated Full Tank Level (FTL) and Maximum Tank Level (MTL)to facilitate the water holding capacity at FTL and release the Water at MTL to ensure safety of the Reservoir.
As per the recommendations of the Expert Committee, G.O.111 was issued notifying the catchment area (up stream) up to 10 Km from FTL of the Water Bodies as prohibited area ( conservation zone )
Basis for identification of the Villages
As there was no GPS etc those days, the 84 villages were identified, as per Revenue Records, falling within the prohibited catchment area of 10 Kms from FTL and listed in Annexure to G.O.111. These 84 villages are only indicative and there can be more areas falling within the prohibited catchment area, which can be more accurately identified and determined by using GPS etc. To the best of my knowledge there does not seem to be any political interference those days, in determining the villages.
Confusion of Vattinagualapalli, Gopannapalli, Kokapeta etc
The confusion regarding Vattinagualapalli is created because of aligning ORR cutting through the prohibited catchment area of Osman Sagar , leaving the village outside ORR. The villages like Kokapata are down stream (not up stream) and there fore they are not the catchment , even though they may look closer to the water body. If one goes by the contours there may not be any confusion.
There are always the black sheep, who built Colleges , Resorts etc in the prohibited catchment area and getting away with murder because of their Political Clout/ Money Power etc.
To the best of my knowledge G.O.111 is based on logical technical, environmental aspects & ground realities and not based blindly on any theories. But unfortunately, because of laxity in implementing its provisions over the last one and half decades , things are made to look absurd as you rightly think or imagine.
Hope I have been able to address the points raised by you.
Sir, Thanks for the detailed responce. But I am still not clear on the scientific authority of the contouring analysis of the land surface and lake bed surface. If you just see going clock wise, J Colony Ph 3 is HUDA approved, then it is 111, then again there is HMDA auctioned sites just because the name of the village changes to Gopannapalli and then again there is go 111 then all IT companies, financial distrits and big sky scrapers??. Definitely not clear, even if you see the survey numbers and their extent, it is not uniformley mapped with all twists and turns like our ORR. Can you please let me know the basis for Survey extent. Why can't we do in clearly connecting shapes like Rectangles, Squares, but is always with all sorts of curves whose boundaries can be changed in the way big people want.

ReplyDeleteThe villages Narasing, Poppalguda,Nanakramguda, Gopannapalle etc are down stream of Osman Sagar( not in the catchment area) even though they are closer to Osman Sagar. The confusion is caused between Vattinagulapalle and Gopannapalle as the ORR is aligned cutting into catchment area of Osman Sagar and making appear that Vattinagulapalle is outside the catchment area.
I tend to agree with you that the boundaries of areas covered by Survey Nos can be uniformly marked in shapes of Squares or Rectangles to ensure method in madness.
If there are any mistakes in marking contours, it can always be corrected by GIS mapping. But there is no way of correcting it, if it is manipulated by the vested interests in collusion with Govt Agencies

Based on my understanding, the entire area on the other side of himaytsagar lake which is between ORR and NH7 falls on the downstream side. Therefore, from the villages like Rajendra nagar, Hayat Nagar, Sathamrai etc. there is no possibility of rain water flowing to the reservoirs located in upper area.How can it is justifiable to restrict residential or commercial development in these areas. This is based on my understanding and I may be wrong. Hence request you to please clarify

Sorry for the delay in response, Ravi.The restriction is not applicable to 10 Km Radius, which includes down stream also. It is applicable only up to
ReplyDelete10 KM from Full Tank Level (FTL) in the upstream. Therefore you are right, it is not applicable to down stream areas. The villages mentioned by you do not seem to be covered by G.O.111.
If there are any restrictions, they may be because of HMDA stipulation that Residential/ Commercial developments up to one KM on either side of ORR require prior permission of HMDA.
I must mention that the location of Shamshabad Airport and alignment of ORR along Himayat Sagar bund are in violation of the provisions of G.O.111.

I've recently visited a venture by name Tejasri Resorts in Vattinagulapally.
It is a panchayat approved venture in about 7 acres of land in survey numbers 356, 358, 359, 368 & 369. It has a plotted area of 24101 Sq yrds, road area of 9728 sq yrds,open area of 2051 sq yrds.
The person who has started the venture claims that, though the land comes under the purview of GO 111, construction can be done in 33-40% of the plots area in G+2 fashion and the rest be left empty.
Moreover, he shows me a sale deed taken from the MCH, Serilingampally stating that the proposed venture falls under "Urban Residential open land" exempted from GO111 under the category "GramaKhantam". can you suggest if this claim is valid or not? If the construction in 33% in G+2 fashion is not valid, is any construction in these plots legal? Forgive me for my ignorance, what is FSI 1:.5 that you have mentioned? should the total construction area (including multiple floors) be restricted to 50% of the total plot area?

My name is KVN Raju and this question is regarding a small gated community in Vattinagulapally village.
Recently, I have come across this venture on the name of Sree homes, who are planning to build around 35 to 40 independent houses inside the village with gram panchayati approval (VRO approval)very close to Sridevi Engineers college (between village and college). I have written inside the village as the venture has existing old houses in front and beside.
When I have asked the builder about Go111, he said within 300 mts radius the residential construction is permitted and showed me panchati approval document ((VRO approval). When we went to Panchayati office to esquire, unfortunately no one was around.
Is it a safe place to invest / purchase a property? Please clarify.

ReplyDeleteIn accordance with the directions of AP High Court in W.P. 9386/07, the Dept of MA&UD, issued Memo No.14046/11/2007 dated 12-10-2007 directing HUDA and the District Collectors, of Ranga Reddy and Mahaboobnagar, to ensure that no construction or development comes in prohibited catchment area of the Water Bodies, in violation of the provisions of G.O.111 and .to keep a strict vigil and take stringent action against the violators as per the law.
The advertisement issued by HUDA and published on 4-12-2007, cautioning against development of layouts in prohibited catchment area of Osman Sagar and Himayat Sagar is also relevant.
Vattinagulapally is one of the 84 villages in the prohibited catchment area as per G.O.111 and therefore no development venture can come up there without violating the Rules.

Thanks a lot Sir, but as per to 111 GO Govt of AP clearly mentioned 500 meters or 1 km away the down stream or up stream of river waters G+2 can be constructed. Is it true. If thats the case can i buy? Please let me know about 111 GO its bit confusing.

I took the permission from Village Sarpanch 3 years ago. Can I build a 2,500 sq.ft farm house as a get away from condo living for wekends? What are the restrictions as I want this to be Green project without polluting.

DeleteWhen various developers like Pragati Resorts, Golconda Hotel etc are carrying out commercial activities in the Bio Conservation Zone of the Water Bodies, I can only say that building 2500 Sq ft farm house for a weekend stay, in a 2 acre farm may be of little consequence. I am fully concious of the problems to be faced by law abiding people in the days of Rule of Jungle and lack of Good Governance. Wishing you all the very best

In the recent approved HMDA Master plan 2031 ,peddamangalaram has been classified as the area under residential use zone 4. Can you kindly let me know does this allows me to construct a house with 40% limiatations.

Thank you Mr. Viswanath.As Vattinagulapally village is one of the 84 villages covered by G.O.111, all the lands within the village limits are covered by the provisions of the G.O.111- prohibiting the development activities.If you plan to undertake any development activity of layouts, bldg complexes etc other than agriculture/ horticulture and related activities , my suggestion is "Not to Proceed". There may not be any problem regarding transfer of ownership/ titles of lands as the sale of property is not prohibited.The problem will be regarding the change of Land Use which is Bio Conservation Zone as per the HMDA Master Plan 2032.

Of Andhra Pradesh ammended GO 111 and isssued NEW GO 261 to addresss catchment areas, 10 km distance from Gandipet/himayat sage lakes, down stream areas etc. Now restriction is only upto 1 km and for certain industries. No restriction on residential construction. Please verify with concerned HMDA officials.

Thank you Kishore for the feed back.I presume you are referring to AP Govt. Memo No. 261/1/2006 of 16-7-2007 issued for regulating the Developments in the Down Stream Areas of Himayat and Osman Sagars. It is more of a Supplement to G.O.111 rather than an Amendment.
DeleteWhat ever is stated in G.O 111 regarding Upstream Area ( Catchment Area) holds good with out any changes /modifications. In fact, it is further strengthened by AP Govt Memo
No.14046/11/2007 of 12-10-2007, issued in compliance with AP High Court directives in W.P.No.9386 of 2007.
I hope, people do not get mislead by misinformation being circulated by parties with vested interests.Please check once again, if you are planning any acquisition of Plot / Development Activity in the prohibited upstream / catchment area of the Water Bodies, as per G.O.111.
FYI. Today I have enquired in HMDA zonal office in Shakarpally for lands covered under G.O 111. The officer (JTO) replied that HMDA wouldn't give any kind of new permission even for using that as form house.

The purpose of G.O.111 is to protect the drinking water sources from pollution and to ensure regular inflows into them, so that adequate water supply is available through out the year. You are well aware of the present state of the two water bodies because of violation of the provisions of G.o.111. If you want to add to that, you are welcome.
DeleteG.O.111 stipulates that 90% of the catchment area up to 10Kms from FTL of the Water Bodies is to be maintained as Bio Conservation Zone. How is it possible if 20% of the area is converted to built up area ?
If the Govt Decides to abandon Osman and Himayat Sagars as drinking water sources , you can hope for relaxation of G.O.111, giving preference for Farm Houses and Resorts over Drinking Water and Biodiversity !

Sir people like you with high tech knowledge should sugest ministry of forest and environment of country and state, to relax from 10 km to may 1 or 2 kms by giving them detailed explanation instead of all these illegal constructions by all colleges , buildings etc. Atleast they can collect property taxes for example CBIT, MGIT, IBS and more right next to himayath sagar lake and other side of the road they are building high rise buildings at Kokapet SEZ auctioned by govt. I may not be able to respond to your satisfaction.The two water bodies are originally meant to cater for the Drinking Water needs of the entire population of Hyderabad, by gravity. But due to phenomenal increase in population and poor inflows into Himayat & Osman Sagars , the drinking water supplies had to augmented by tapping from Singur Reservoir and Nagarjuna Sagar Reservoir through Stages I & II Pipelines, in addition to dwindling supplies from Himayat & Osman Sagars.
DeleteYes, the water has to flow from high altitudes to lower altitudes, irrespective of ORR.Just because the ORR is aligned through the prohibited catchment area of the Water Bodies, the natural phenomena of the water from Vattinagulapalli finding its way into water bodies does not stop.

Dear Karthik, property in "Grama Kantam" may not be a good proposition as these lands are basically meant for common use of the residents of the village.The Supreme Court by order dated 28-0`1-2011 in Civil Appeal No.1132/2011 @ SLP(C) No.3109/2011 directed all State Govts. that they should prepare schemes for eviction of illegal / unauthorized occupants of Grama Poramboke Lands and they must be restored to Grama Sabha / Panchayat for the common use of the villagers.Similar Order was issued by AP High Court in W.P.No.25150 of 2012 by its order dated 14-08-2012.
DeleteTherefore suggest that the property in "Grama Kantam" be avoided , though Puppalaguda Village does not figure in 84 villages identified in prohibited catchment area of the Water Bodies by G.O.111.
I think the people of 84 villages are not able to enjoy the benefits of the Hyderabad growth when all other villagers are enjoying.

As per the info I have, Kollur / Peerazadiguda / Beeramguda are not covered by the 84 villages listed in G.O.111.But please check from HMDA regarding the land use of the Plot in which you are planning to buy a house.

Budvel in Rajendra Nagar Mandal is not covered by G.O.111. But make sure that Housing Society has got the approval of HMDA for developing the layout.

ReplyDeletefurther to my mail to you posted at 2.43 PM on March 12, 2013, I have been provided with a GO No. MS 257 of 2.5.2000, wherein it is stated that the draft variation as published in Gazette No. 155 of 28.3.2000, did not receive any objections and suggestions and hence the proposed draft variation has been confirmed.
According to the said variations No. 7 ( Block VII), the sites in Sy Nos 147 to 149 and 165 to 265 at Vattinagulapally village to an extent of acres 1170 which was earmarked for conservation use zone in the notified Master Plan for non municipal area is designated as residential use zone, subject however to NOC from Water Works Hyderabad Metro Water Supply and Sewerage Board Hyderabad at the time of applying for development permissions.
Thus I believe that the said Survey No. 222 automatically got covered in the said GO and has now status of residential use zone. Land conversion fee is required to be paid to get the land converted and start development.
Kindly provide your esteemed opinion on this.

DeleteBut Govt of AP has committed a fraud by issuing the G.O. No 257 converting the conservation zone in Vattinagulapalli village covered by G.O.111 to residential use, in utter disregard and violation of the stipulations and the spirit of G.O.111.
Even God, if there is one, cannot save the future generations heading into ecological disaster for which the present generation will be responsible..The Govt is treating the" Land as a Commodity" to meet the present needs, depriving the future generations of their needs

Then they will issue a GO to restrict developments, rather to create ways and means for filling their pockets and then they will issue newer GOs to allow developments selecting the areas, where large corporates have already shown interests.
This is agony but a bitter truth in our country. I agree with your views as given in your reply of March 12. Future generation shall make us responsible for punishing them due to ecological disaster.

I am receiving offer from a builder for high rise development and apartment at a good price but worried about GO 111 guidelines. Can you kindly guide me on applicability of GO 111 despite issuance of GO 257.

1- I have 50 acres of land under the airport terminal building to the south. The land was under a village by name Jamaalshah guda which for some reason has been added to the pan book(tax) of Gollapally. When i look into the map issued by survey of India in Gollapally, there is no demarcation of my land. However it shows Jamalshahguda as a neighbour to the south. Will it be safe to assume that i am not part of 111.
2- i have used Google earth to measure the distance from FTL to my village(Jamalshah guda) boundary and it is more than 10 KM, it is 11.62km. Will this give me an additional reason to celebrate.
3- I have tried to locate the map of Jamalshahguda at Survey of India, but none exists.

Thank you Amer. With the alignment of ORR and building of Shamshabad Airport, the applicability of the provisions of G.O.111 have considerably changed particularly around the Airport.
DeleteIf my information is correct, HMDA Master Plan 2031 does not show even Gollapally as conservation zone. Please cross check this to be doubly sure. I think your land may be outside the scope of G.O.111.

It is G.O.111 of 1996 which lays down the limit of 10 Km from FTL in up stream and listed 84 villages in the prohibited catchment area and the Supreme Court order of 2000 upheld the provisions of G.O.111.

This the same question I posed to Commissioner HMDA, a while ago. He said it is drainage and watershed pattern of Bulkapur. But Bulkapur falls outside 10 KM radius from the tank.

As per the Developer, it comes under Survey No 25 & 28 and it is an gram panchayat layout and comes under Rajendra Nagar Mandal. As per the G.O.111 and the above all discussion, it is clear that we cannot construct any house, but to my surprise i saw an Apartment construction in this area. Is it possible to buy any plot around 200 Sq.yards in Survey No.25 & 28 and can we construct any house with Panchayat approval.
Some of the Developers in Khanapur Village even say G.O 111 has been reduced from 10 KM to 1 Km Range. Please let us know is it true?

Khanapur is one of the 84 villages identified, as per G.O.111, in the prohibited catchment area of Osman and Himayat Sagars and no development activity is permitted officially in the prohibited area, which is classified as Bio- Conservation Zone.The prohibited area notified by G.O. 111 has not been reduced to one KM and still remains as 10 KM . The development coming up in the heart of the village will amount to illegal activity.

"Gramakantam" may mean the Village Residential Area / Limits. Whatever it may be, the Gated Villa Community cannot legally come up there. Please check, if it has the approval of HUDA/ HMDA ?

When I enquired some real estate agent told me that now Khanapur area comes under some "GramaKhantam" category where one can build houses with G+2 permission after getting LRS. Is that right? Is GO No: 111 still existing or any amendments made to it? Please clarify.

The provisions of G.O.111 are still valid and there are no amendments. No development can officially come up even in Gramakhantam without approval of HMDA .

My son went Kishan guda near ORR & NH7 Crossing to see a venture of CSK REALTORS. He was told that it comes under Grampanchayat and that he got approval. I found the place to be at 1km distance from the ORR and also very close to AIRPORT surrounding area. I told him that there are some restrictions on construction in such locations (around ORR). At the same time I told him may be they should get Directorate of Town planning before getting the approval of the Panchayat. WE didnot find the survey number on the Venture Document. I told him to get that for further enquiry etc.,
I request you to provide some guidance on the matter. To whom should we approach to get matter clarified.

There may not be any problem regarding plots on Srisailam Highway as it is not covered by G.O.111 , but please make sure the layout of this project has the approval of HMDA.As there are some more projects on this road , it may be advisable to visit them and satisfy yourself regarding the facilities being actually provided by them before you buy any property.

I am planning to buy a 500 yds plot there. But I have observed that there is no remarkable price appreciation in last 5 years.What do you suggest?
I am not very knowledgeable about real estate transactions. As the developments such as FAB City etc originally planned are kept in cold storage for the last 4 to 5 years, the demand for plots in this area was slack. It is recently reported that two Electronics Manufacturing Complexes/Estates to be set up in this area have been approved by Govt of India.

Then a tentative layout of the land was made and offered the same to the Wipro employees.
Since then, we have not been able to get the layout approved due to GO111.
Can you please let us the situation with respect to GO111 and any specific knowledge of this piece of land (survey#189).
It's been more than 10 years we have been holding on to this investment with a hope of construction a house. What is your advice?
Should I hold on to this property? Can I construct as the GO111 guidelines by leaving 60% open space? Is a there a exit route otherwise?

The situation in Vattinagukapalli village covered by G.O.111 has been completely distorted and muddled with alignment ORR cutting through Bio Conservation Zone at the village and the issue of G.O.357 dated 2-5-2000 converting huge chunk of land under Bio Conservation into Residential Use.
DeleteYour Survey No.189 is covered by this infamous G.O which can be challenged in the court of law. and has no validity in the light of Supreme Court Land Mark Judgement dated 1 st December 2000
The Dept of MA&UD issued the Memo No.14046/11/2007 dated 2-10-2007 in compliance with AP High Court Directive in W.P. No3986 of 2007 , prohibiting all development activities layouts etc in the Bio conservation Zone covered by G.O.111 .
According to me, this notification is applicable to the entire area covered by G.O.111, irrespective of the Orders issued permitting the change of Land use. Therefore no development activity can take place in Sy.No 189 and other Sy Nos covered by G.O 357
As far as I can see, there is no exit route, you are trapped.. If you want to stick on to Sy.No 189 it is going to be A High Risk Gamble . Choice is yours

How can the movietowers get the permission to built 19 floors. Then why not vatti nagulapally village get this type of permissions does this movietower does not cause hindrance to pollution control board. Please explain.

The sales guy boasts about US Consulate, Plots for IAS officer in near by area etc. Curious to know if this area where of proposed venture also comes under the GO 111? Can houses be built at all? If yes does the 60% free area apply here as well?

As it stands to day, No Development activity comprising of layouts, building activity etc can be under taken in Vattinagulapalli village covered by G.O.111.The Survey No.125 is not covered by G.0.257 dated 2-5-2000 , which itself has no legal sanctity, permitting conversion of Land Use from Bio Conservation Zone to Residential Use..

The G.O. No 522 dated 4-5-2006 allotting land in Sy N.o.132 to IAS Officers is not valid Therefore development of Sri Lakshmi Enclave in Sy No 125 amounts to be an unauthorized activity.

ReplyDeleteRespected Sir, My issue is regarding Sy.No 1018 of Ameenpur, Beeramguda, Patancheru Mandal initially in 1985 it was sold out to Industrial Employees (low income) under Society name Industrial Employees Housing Board Society which is registered at that time by Registered GPA Holder now all employees who purchased the plots have EC and sale deed documents on our names but successors of land owner who sold it to GPA holder are in procession now. What we need to do. I thankful to your kind consideration of our questions.
I am sorry, I may not be of any help in this regard, as I have no knowledge of land transactions that too, complicated ones of Hyderabad. Suggest that you seek the legal opinion.

ReplyDeleteGO 111 released after 1990. Plots were made by Sreeramnagar Society (secretariat colony) and sold to employees in the year 1990. Along the conduit to Asifnagar, min. area under FTL as on mid september 1990 may be made known. What is the fate of those who have purchased plots in 1990.
Even if the plots are purchased in 1990, prior to issue of G.O.111 , the provisions of G.O.will be applicable to all lands in the prohibited catchment area.However if the constructions had come up prior to the date of issue of G.O - March 1996 , they may not be applicable.

The person who have constructed before march 1996 is lucky fellow; and others are the losers. then the purchaser of the plot with his savings has to suffer today for no fault of his? For what reason. Conduit is a pipe line to asifnagar. For what do you need 100' on either side sir. why do you want to play with our hard earned money. Is GO March 1996 made know to the public sir.
Have you ever visited this place sir. People have constructed unofficially on the conduit and running businesses. Some constructed buildings (unauthorisedly) and constructed ramp on to the conduit submerging the conduit Sir, big buildings, business people and ventures have erupted in gachibowli and no one speaks there. Why only those poor fellows who have purchased plots nearby the conduit and unaware of this GO has to suffer. Why don't you leave this and save us from mental trauma. I request your kindself to kindly release the issue of 100' on either side of the conduit for which act my generations will be thankful to you. Sir, ganesh idols are dropped in all the lakes (earlier only tankbund). More than half of Kapra lake has been encroached. Now idols are dropped into these lakes. Why don't you try to protect the lakes. Hope I will get a reply. Thanking you.

I entierly agree with you regarding encroachments, illeagal constructions , Lakes pollution, encroachment of water bodies etc. But unfortunately the mafia of Neta, Babu and Realestate nexus, is law onto itself , while the citizens remain helpless spectators.
With regard to encroachments along the conduit referred in G.O.111 , i am in agreement with you. The G.O. was well intended for the purpose of protecting drinking water supply to the city.
I used visit the area quite frequently, but I have not visited for about last 8 years because of indifferent health.
I am sorry, if i am resposible, for the mental trauma caused.

ReplyDeleteI have recently seen a gated layout [Survey No. 696, Janwada] belonging to Sri Infra. The agent claims that this survey no longer comes under GO 111. When I checked the HMDA maps I still find it in the Bio Conservation zone. There are some articles in news papers that some part of Janwada has indeed been removed from the Bio Conservation Zone.
Can you please let me know if it is safe to purchase a plot in the mentioned Survey number?

It is a fact that change of land use of an area of around 30 Acers in Sy.No.696 of Janwada Village was permitted by AP Govt by issuing G.O. No. 293 dated 26-07-2011. This is highly discriminative, irregular and in utter disregard to Supreme Court and AP High Court Directives with regard to change of land use in the prohibited area covered by G.O.111. This was brought to the notice of the State Govt. Under the circumstances, the option to purchase of plot in in this Survey No is left to your choice .

I have 1000 Square yard( 2 Plots of 500 Sq. Yards each abutting each other) in Shankar(i) Hills Lay out, Located next ORR coming under Vattinagulapalli Village in Rajendra Nagar Mandal.
I know that this entire lay out is coming under the purview of G. O 111.
From the latest information you have kindly educate me the implications whether any house canbe constructed and if yes what is maximum allowed % of area.

DeleteThe AP Govt issued G.O.257 of 02-05-2000, converting the Sites in Survey Nos.147 to 149 and 165 to 265 to an extent of 1170 Acers in Block VII of Vattinagulapally from Conservation Zone to Residential Use subject to obtaining NOC from HMWS&SB . Though it is in violation of the provisions of G.O.111, it is the ground reality and many people are understood to have under taken development activities. I am not aware if Shankar Hills Layout comes under this modified area and I have no particulars of the people in this layout.
