G.O.111- Beware of Layouts in Vattinagulapalli!

G.O.111

 

The State Government of AP, realizing the significance and importance of providing safe drinking water for the progress and well being of the citizens of Hyderabad, issued G.O.Ms.No. 111 M.A dated 08-03-1996, for protecting Himayat Sagar and Osman Sagar, the main sources of drinking water supply to Hyderabad & Secunderabad. The salient features of the G.O. are

 

*To prohibit polluting Industries, Major Hotels, Residential Colonies or other establishments that generate pollution, in the catchment of the   lakes up to 10 KMs from Full Tank Level (FTL) of the lakes. - Para 3 (i )

 

*Residential developments in residential use zone may be permitted with 60% of  the total area kept as open spaces and roads in all layouts  in the villages of prohibited catchment area- Para 3 (i) (a)

 

*To restrict the FSI to 1: 0.5 in the catchment area. This measure will ensure that 90 % of the area remains under agriculture, as is the practice now and ensure protection of the lakes- Para 3 (i) (c) 

 

 *The land use of about 90 % of the area is classified as recreational and conservation use in the Master Plan. The HUDA should take action for classification of this 90% of the area as Agriculture, which is inclusive of horticulture and floriculture –Para 3 (i) (b)

Accordingly HMDA classified this area as bio-conservation zone

 

 Supreme Court Judgment

 

The Supreme Court in its land-mark Judgment dated 01-12-2000 observed that having laid down the policy prohibiting certain activities within the catchment of the reservoirs, the government could not pass orders of exemption having dangerous potential, unmindful of the fate of Lakhs of citizens of the Twin Cities, to whom drinking water is supplied from these lakes. Also observed that such an order of exemption carelessly passed, ignoring the "Precautionary Principle" could be catastrophic.

 

Directives of State Agencies

 

In accordance with the directions of AP High Court in W.P. 9386/07, the Dept of MA&UD, issued Memo No.14046/11/2007 dated 12-10-2007 directing HUDA and the District Collectors, of Ranga Reddy and Mahaboobnagar, to ensure that no construction or development comes in prohibited catchment area of the Water Bodies, in violation of the provisions of G.O.111 and .to keep a strict vigil and take stringent action against the violators as per the law.

 

The advertisement issued by HUDA and published on 4-12-2007, cautioning against development of layouts in prohibited catchment area of Osman Sagar and Himayat Sagar is also relevant

 

 The other aspect is that sanctioning of layouts with 60% of layout area as open spaces & roads, F.S.I. of 1:0.5 etc in the prohibited area, in violation of 90 % of the total area of the prohibited catchment for agriculture use, is nothing but violation of the provisions of G.O.111.

 

Caution

 

Vattinagulapalli village, in Rajendranagar Mandal of Ranga Reddy District, is one of the 84 villages falling within 10 Kms Catchment Area of Osman Sagar and Himayat Sagar

as per Annexure-I of G.O.111.

 

If you are looking for a Plot or a House in the Layouts outside ORR towards Himayat Sagar & Osman Sagar , please check that the Layout is approved by HUDA /HMDA and it is not  in Bioconservation Zone notified by HUDA / HMDA and conforms to restrictions stipulated in G.O.111

  5. One can find the land use and zoning classification details at www.hmda.gov.in website.

    Click on master plan map of respective zone, to check the land use information.

    The zoning classification of land use is defined in GO 288 or 287 pdf/doc.

    Per my inquiry at hmda office, Land area falling under bio/conservation zone (GO 111), there won't be any construction allowed of any kind. Respective body - hmda or panchayat or municipality - will not accept the building or layout permission application itself if it is falling under the conservation zone. Those areas are earmarked for agriculture use only with very few exceptions as defined in GO 288 with very very limited scope (ex Education institute with minimum 10 acres land but with only 5% scope for school bldg with only two floor height; etc).

    I am confused about GO111 rules.Can someone please clarify. will i be permitted to construct a house not more than 10m / G+2. Or am i not allowed to construct at all.

    I was told by folks that i can get a G+2 permission from panchayat.

    I plan to buy a plot somewhere near to APPA. Any help is highly appreciated.

  8. The area near APPA may not come under prohibited catchment area as per G.O.111. Please check this.

    As per info available, Gram Panchayat cannot give permission for construction activities in prohibited catchment area. Please check with HMDA

    Constructions in prohibited catchment area may be permitted by HMDA subject to the following
    a) FSI 1:0.5
    b) If it is lay out, 605 of layout area is left as open spaces & roads
    c) 90% of total prohibited catchment area is left as bio-conservation
    area

    Hope I have been able to address the points raised by you. You may say the ground realities are no where near what is stated above.What else we can expect, when there is no Governance, leave alone Good Governance, to ensure the Rule of Law, with transparency and accountability.

    Non- compliance has become a High-Profit Business, instead of being a High-Risk Business, in the present rule of the jungle in the Concrete Jungle of rapid urbanization, consumerism etc in the name of so called development.

    situated at RALLAGUDA AMLET OF SHAMSHABAD (V) AND (M),RR DISTT.),
    as u mentioned in your previous post that rallaguda doesn’t come in the list of 84 villages which got prohibition.
    I would like to know below things
    Is that area under G.O. 111?
    If yes, how to find whether CSK has taken permission to build villa's as they are building more then 200 villas its about 240+.
    Is there anyway we get regularized in future and
    is there anything like they(govt.) going to reduce from 10 to 5kms FTL of himayatsagar and osmansagar.
    even canara bank is giving home loan for the same, but before i approached to HDFC bank they didn’t.

  12. As per the info I have, Rajendranagar is not one of the 84 villages identified in the prohibited catchment area as per G.O.111.The villages Khanapur, Gungurthy, Vattinagulapalli etc of Rajendranagar Mandal are covered by G.O.111.

    Even though property in Manasa Hills in Rajendranagar appears to be safe on the face of it, suggest that you please get confirmation from HMDA that the lay out has its approval.

    Recently, we have seen a layout in Khanapur, and it has construction approval from panchayat, we heard about G.O. 111, but we were not sure whether we can't construct at all or we can construct till G+2.

    After reading your blog, I understand that we can't construct at all.

    But, after reading few columns from other sources like news paper articles, I found that it has been exempted for few villages. Here, I am confused.

    Please answer my questions:
    How can I get the latest G.O. 111 details?
    How would I know whether that layout is approved by HMDA/HUDA?
    Shall I go with panchayat approval?
    How to contact HMDA?

    We are really in confusion, please help.

    1. I can fully appreciate your predicament, when there is no Rule of Law in the Concrete Jungle where the Neta /Babu / Real Estate Mafia dictates and the Urban Land is being treated as a Commodity ?

      a) G.O.111 of 08-03-1996 still holds good and there is nothing like latest. I can send the soft copy of the G.O, if you can let me know your Email ID
      b)Please ask for the info from HMDA under "Right To Information"
      c)Panchayat approval will not be valid for lay outs and the areas covered by G.O.111

  16. Hello Rama Rao sir,

    I am one of the victim under GO 111. I bought a plot in one of the venture back in year 1999/2000. At that time I didn't even know about this GO 111. When I realized after few years I came to know about this GO 111 and that we are not permitted to construct a house. Not sure what to do now. I thought of constructing my dream home in that plot which can be eventually useful for my kids in future. The Developer of the land did not disclose this when buying. He showed us he got all permissions/link documents which are all perfect from respective Gram Panchayat( NARKHUDA VILLAGE).
    My questions are
    1) If that entire lay out falls under GO 111 why would Gram Panchayat allowed developer to layout (500 + plots) ?
    2) Developer made the money and left the scene long time back. How can I get compensated for this loss ? who should I consult for justice? What are my options ?
    3)I have seen various notices from HADA after that notifying illegal layouts. There was no HADA(Hyderabad Airport Authority Limited) at that time of buying.

    Any suggestion would be greatly appreciated.

    1. I fully understand your predicament under the circumstances.Taking advantage of lack of responsibility and accountability in the governing system, the Gram Panchayats in collusion with higher ups and developers have taken the innocent citizens for a ride.

      Even the AP High Court seems to have become a passive onlooker of the blatant violations of G.O.111. Even God, if there is one, may not be able to help to protect Drinking Water Sources Himayat and Osman Sagars and the many victims like you in the present system of Rule of Concrete Jungle controlled by the Land Mafia / Neta / Babu nexus.

    I got a land sale proposal from a person who stays at himayat sagar village. Since 25 years he has been staying in himayat sagar village.

    Now I am planning to buy a plot in himayat sagar village itself but he is saying that they don’t have any layout for the village and they don’t have any survey numbers.
    So my question is, shall I proceed further to buy the plot in himayat sagar village or withdraw the proposal.

    Apart from layout and survey number issues the other documents are very clear.
    I request you to please suggest me how to proceed further.

    1. Presume you are revering to Himayatnagar village of Moina bad Mandal It is one of the 84 villages covered by the prohibited catchment area as p[er G.O.111. Moreover if there is no Survey No and the layout is not approved , please do not opt for the plot

  20. DEar rama rao sir....please conform me...one thing i bought a land in khanapur survy numbers are 222 and 220 ...i got plot in this survy numbers which mesures 600 yards nearly...
    i notified that survy numbers in RESIDENtial ZONE in HMDA latest mater plan...
    and the 10 km radious is not aplicable nw as per 261 g.o
    now its exmpted to 500 mtrs of the FTL
    how ever 300 mtrs mtrs from the village is considared as residential zone (eenadu telugu paper 15 page )
    the company showed all the documents what i told to you sir....
    but your knwldge is not updated or not i dont knw ...but i saw al news ppr and dat go copy evn dat hmda master plan shws it in R1 zone.....but i dont knw y you say like dat...please update urself ...

    1. Thank you for your observations..I presume you are referring to AP Govt. Memo No. 261/1/2006 of 16-7-2007 issued for regulating the Developments in the Down Stream Areas of Himayat and Osman Sagars. It is more of a Supplement to G.O.111 rather than an Amendment.To the best of my knowledge there is no.G.O 261 relaxing the provisions of G.O.111.On the contrary, there is AP Govt Memo No.14046/11/2007 of 12-10-2007, issued in compliance with AP High Court directives in W.P.No.9386 of 2007.I hope, people do not get mislead by misinformation being circulated by parties with vested interests.

      The G.O.No.257 dated 02-05-2000 issued by the State Govt permits conversion of Sy. Nos 220, 222 etc for residential use in utter disregard to the provisions of G.O.111 which is liable to be challenged.

      Hope I have been able to respond to your satisfaction. You can imagine my condition at the age of 84. in updating my knowledge or being misguided by wrong info ?

    One of my relative is planning to open a school and looking for land near ORR. Some brokers told them that they can buy land in GO-111 or bio conservation area as educational institutes are allowed to construct with a restriction of G+2. Is this information correct?

    1. The plot in Pattancheru, one or two Kilometers from ORR may not have any problems. Please make sure of the ownership of the land and its Land Use as per HMDA Master Plan

    1. G.O.111 restrictions are not applicable for building activity beyond 500 mtrs down stream villages, subject to getting the the required statuary approvals/clearances. If it is one of the 84 villages upstream in the prohibited catchment area covered by G.O.111, it will not permitted legally.

    1. My suggestion is, please do not opt for any property in ventures of Vattinagulapalli village as it is one of the 84 villages identified in the prohibited catchment area of the 2 water bodies as per G.O.111

      As per info available with me , Mokila does not seem to be covered by G.O.111. However please get clarification from HMDA regarding the ventures in Mokila , to be on the safe side..

Khanapur is one of the 84 villages identified, as per G.O.111, in the prohibited catchment area of Osman and Himayat Sagars and no development activity is permitted officially in the prohibited area, which is classified as Bio- Conservation Zone. There is no possibility of getting building permission.

      My advise is not to purchase the plot in Khanapur village to build a house with Panchayat approval which will have no legality. Please do not get mislead by layouts coming up which are illegal.

    we are a group of 8 senior citizens plnning to construct retirement homes occupying about 6400 sft (8 cottages, each 800 sft) plus about 2000 sft of common recreational (gym etc) building with the rest being garden - in one acre in a bio-conservation zone near Shamshabad airport.That works out to 20% land usage. Is that eligible to be considered by HUDA/HMDA for approval? Can I have a soft copy of GO 111. Thanks and regards.

    1. As per the Notification issued by State Govt. in accordance with AP High Court directive , no development activity can be undertaken in the prohibited area as per G.O.111, classified as Bio Conservation Zone. The G.O 111 stipulates land usage of the entire prohibited catchment area.

    1. You are correct that G.O.111 does not ban total construction activity. But G.O.111 stipulates that
      the land use of about 90% of the area be classified as recreational and conservation use in the Master Plan. Therefore HMDA should take action for the classification of this 90% of the area as agriculture which is inclusive of horticulture and floriculture by restricting the construction activity.
      The ground reality is that much more than 10 % of the prohibited catchment area has already undergone the development/construction activity. You can well imagine the predicament of HMDA ?

    As per the HMDA maps Survey Number 228 of Khanapur is designated as Residential Zone (R1). Does this mean this is fit for residential purposes? If yes what % of the area should be left free?

    Thanks for your blog shared with lot of views and many issues were answered at great help, I have plot in Jukal and this comes under catchment area GO 111MS. The catchment area seems to be upto 10kms of both the sagars( as per the GO 111) but when we calculate the distance from Jukal to himayatsagar is 20.5 kms and to Osmansagar is 29.2 kms. Can you sort this out how is this catchment area is calculated.

    With regard to Jukal village, the prohibited catchment area of 10 Kms is from the Full Tank Level (FTL) of the reservoirs.

    firstly i appreciate your effort towards this issue and the blog is really helpful and i am a regular follower of your blog as i am an employee of p & G that is being located in close vicinity to shamshabad and for me it is suitable that i stay in shamshabad

    i booked an house and have paid nominal advance to the builder in a gated community in shamshabad which is attached to the village settlement in that area. the developer has obtained permission from panchayat for g + 1 and the land is falling under general development promotion zone which i understand from the master plan that residential activity is permitted.

    as per your previous blog i understand that if the builder is leaving 60 % of the layout as open it is allowed with that i am ok as i have checked the same with the builder and the layout and they have earmarked 60% open area

    now my query is that when i visited the panchayat office they said that it comes under go 111 and no construction activity is permitted

    kindly advise what should be my stand as i am a little confused with all things happening around.

    as suggested by you and other referances i am under the impression that if the land is earmarked as residential zone and is within the limits of the gram kantham, and the builder is following the 60% norm then there shall be problem with construction.

    1. I am sorry Kumar for the confusion. Your impression was correct. But unfortunately the development activity in the prohibited area has increased so much reducing the total area under conservation / agriculture less than the stipulated 90% of the prohibited catchment area . Therefore the blanket ban, which is also being violated. Only law abiding people like you face this problem.

    1. The investments in layouts coming up near Shamshabad Airport, are likely to be risky as the area falls in the prohibited catchment area as per G.O.111 . Suggest that you approach HMDA and find out if the layout of Namishree has the approval of HMDA, before you proceed further and invest your hard earned money .

  45. we are planning to buy a independent house in rampally village, keesara. as per the docs it is covered under gramkantam and no banks are giving loans. we want to build on the same in future. but not sure if we will get LRS on that plot and also if we will get loan on the same for construction.     1. The right agency to approach for clearances is HMDA .According to the State Govt.Instructions issued as per AP High Court Directive, no development activities are to be permitted in the prohibited catchment area as per G.O.111.

  50. Thank you Radhika Though Kolluru is not in the list of 84 villages of prohibited catchment area covered by G.O.111, Hyderabad Master Plan shows Kolluru along with Vattinagulapally in the Conservation Area .Accordingly no development activity can be undertaken in the Conservation Area .

    Suggest that you please visit Website of HMDA , in which various layouts approved by HMDA are listed under Planning . Please get in touch with HMDA and get confirmation that the Gated Community in which you are planning to buy a Villa, has their permission. Also please request the Developer to send you the copy of HMDA approval for the layout of the Gated community.

Thanks Sir for your timely response, Actually the humminghub venture (http://www.humminghub.in/villa1.php) is near Village Velimella village, Ramachandrapuram Mandal (I think very next to Kollur) and currently they are waiting for HMDA approval to commence the construction work. They told they have already applied and mostly will get with in 3-4 months once the elections are completed. Does this Velimella still comes under conservation Area? They are telling that they will give the advance payment just in case of any rejection from HMDA. Kindly suggest.

    2. Velimella Village of Ramachandrapuram Mandal does not come under the prohibited catchment area as per G.O.111.but HMDA approvals are required for development of the layout, which are invariably being managed.

      To wait till HMDA approval is obtained is a better option , but if there is going to be huge price difference between now and after HMDA approval, you may consider taking the likely risk. Good Luck.

    We are planning to buy a plot in Kapra, it comes under Kapra municipality. it has survey numbers and many buildings are also coming up there. Janapriya housing also has its presence there. Could you please advice if we could go ahead n buy this property.

    Also, please suggest if you are aware how to get a LRS, as for bank loan LRS is a must. An approved layout sanction copy from GHMC wud also work for loan approval is wat the bank has said. Kindly guide how can we get an LRS or approve layout plan copy from the municipality and how much time it would take.

    We plan to construct in a year or two, what are the necessary requirements for us to start this project. please guide how many floors can be built on 150 sq yds.

    Your early response will be highly appreciated as the plot owner is coming to meet us soon.

    1. The purchase of house plots in Kapra Municipal area may not have any problem subject to clear titles of the land and notified Land use. If the plot is in an approved layout either by GHMC /HMDA, it is safe. The developer of the layout should provide you a copy of the approved layout.

      But if it is a piece of land to be purchased, please make sure of the titles ie ownership , notified land use etc. before you go further to purchase.I am not familiar with the process of LRS. The number of floors that can be built on the plot of 150 Sq.yds.will depend on the prevailing rules of GHMC with respect to the location of the plot. Normally the built up area cannot be more than 1.5 to 2.0 of the plot area subject to leaving the statutory open spaces

    I have read lot of articles but no where got clarification on constructions made along the conduit which is from Osman Sagar to Asif nagar. I get confused on the words MINIMUM and MAXIMUM in the below pharse . My question is whether constructions should be allowed from 9 mts from the canduit or 100 feet from the canduit.

    "(ii) For the protection of raw water channel from Osmansagar to Asifnagar no layout or building permission should be granted by Municipal Corporation of Hyderabad / Hyderabad Urban Development Authority / Director of Town and Country Planning up to a maximum of 100 ft from the conduit site boundary. While approving the layouts along the conduit, a minimum of 9 mtrs wide road plus green belt to a maximum width of 100ft should be insisted to act as buffer on either side of conduit and the green belt shall be accounted as part of mandatory open space to be left the layout. Drainage pipe lines must be laid parallel to the conduit and no sewerage/sullage water discharged shall be allowed from the layouts towards the conduit"

    1. Sorry for the delay in response. The main objective of the directive is to prevent / avoid contamination of drinking water channel.
      It stipulates 100 ft of open space to be left on either side of the conduit inclusive of the road of minimum width of 9 mtrs plus green belt. Therefore no constriction can be under taken within 100 ft from the conduit.

    1. Sorry for the delay in response. If the developer cannot provide sanctioned layout plan , it appears to be fishy. Before you finalize the purchase, please try to get the sanctioned layout plan of the area from HMDA . I have no idea of the present status of LRS.

  54. Dear Sir, I have got an offer to buy a plot in Hariguda. The plot is on the other side of the ORR and close to Himayatsagar lake. The owner of the plot has informed that it is on the downstream side of the lake.     1. Sorry for the delay in response.Harrigudda of Shamshabad Mandal is one of the 84 villages in the prohibited Catchment Area as per G.O.111 and falls within Bio Conservation area. Please contact HMDA for any other clarification.

    I saw all the discussions on the 111G.O, I am planning to buy a plot in vattinagulapally in a venture, Sai Surya Developers under Survey No: 477;(Village Approved Layout) Think this falls under conservation Zone..But this venture outside Grama Kantham is within 300 meters of Grama Khantham limits.
    --I spoke with Village Sarpanch and they are saying that they are ok to give permission for G+2, for constrution. As per your previous Blogs/ conversations, I understood that Village panchayat doesnt have authority to give permissions for any sort of construction.
    --I heard that village panchayat limits (Grama kantham limits) will be extended by 600mts., and if the plot is in the grama kantham limits there would be no problem for construction, Am I right or not?
    --Developer showed us a document(Market value Assistance Certificate) from Govt. of Telangana registration and Stamps and Dept, which shows that this survey number is classified as: Residential. Does this mean that we can go for construction in that survey number?

    I have a query relating the survey number 101 which is marked as KUNTA in pupplaguda village Map Rajendra nagar mandal RR Dist. As per the Land use Certificate and master plan issued by the HMDA the survey number 101 is specified as RESIDENTIAL ZONE .
    I did not find any G.O related to conversion from water body zone to Residential zone for this survey number.

    Also there are no water body hatchings marked around this survey number 101 in the village map .
    Can you please let me know if it is safe to buy the plot in this survey number as its marked as KUNTA . If i go ahead and proceed will i get the building permission from HMDA without any hurdles .

    Now can you kindly suggest me in which way i can utilize that land in an eco frindly as well as legal manner(or else sell off)...ofcourse i dont have plan to use it either for commercial or residential purposes which is against as per the G.O too......

    I am glad to see this blog and the information provided regarding 111 GO. I really appreciate the blog owners help and support in guiding the young generation to inverst wisely. With respect 111 GO, I would like to add that recently I too purchased about 1000 Sq.Yards commercal property in Ganadiguda Village, Shamshabad Area very near to NH7 and ORR. Basically, I am a NRI and I did this investment based on my feedback and suggestions from my family members. I was aware of the fact that only G+1 is allowed in this area being near to the new Air Port. However, when I come to know about 111 GO I stated to get google around about it as it made it little worried. Hence, I would like to know if this area comes under Bio-Conservation Zone ? And also I heard about the recently changes in the remapping of districts in TA where in the CM declared shamshadbad as new district. Now, I wanted to know if this will effect the property rates in this area? will it increase or decrease ? And I have some other queries too which we can discuss later or in person if you share your contact details.
