ORR Growth Corridor- Draft Master Plan 2031- G.O.111

 
 

The Outer Ring Road (ORR) was aligned along the bund of Himayat Sagar and cutting across the prohibited catchment area of Osman Sagar between Vattinagulapalli and Khanapur villages of Rajendranagar Mandal of RR District in supersession of the provisions of G.O.111 and in disregard to Supreme Court directive dated 1 st December 2000. This is likely to result in acidification of the reservoirs due to air pollution from heavy vehicular traffic on ORR. The necessary measures need to be initiated and implemented, for developing a massive Barrier of Green-Belt on water front side of the ORR. to prevent acidification of the drinking water sources.

 

Development Activities in Prohibited Catchment Area

 

 It is observed that considerable development activities are taking place around Vattinagulapalli village and towards Khanapur village, both of which are in the prohibited catchment area. This is happening in spite of MA&UD, Memo No.14046/11/2007 dated 12-10-2007, directing HUDA and the District Collector of Ranga Reddy, to ensure that no construction or development comes in prohibited catchment area of the Water Bodies. It also directs .to keep a strict vigil and take stringent action against the violators of the provisions of G.O.111, as per the law.  

 

Developments Down Stream

 

 The State Government, with a view to prevent any possible direct pollution into Osman and Himayat Sagar lakes, the main drinking water sources for Hyderabad, issued  Memo N0.261/1/2006 dated 16-07-2007 specifying the regulation measures, applicable to the Down Stream areas of the two water bodies. Some of them are:

 

a)No development up to 500 Mtrs  from the Bund/FTL in the Down Stream and declared 
    as Prohibited Zone

 

b) Beyond 500 Mtrs and up to 1000 Mtrs ( I KM ) in the Down Stream , only low rise
    Residential development (G+2 floors) will be allowed

 

c) Beyond 1000 Mtrs distance in the Down Stream, all developments such as
     Residential, Commercial, I.T Units, Hotels, Public & Semi Public developments,
     except the specified 68 industries are permitted.

 

d) HMDA is designated as the Nodal Agency to enforce these Regulations

 

The Gandipet is one of the villages within 500 Mtrs, down stream and should be treated as prohibited zone as per the Memo dated 16-7-2007. But unfortunately, considerable development /commercial activities are reported to be taking place around there with or without the knowledge/consent of the authorities concerned. This needs to be prevented before it is too late.

 

Activities in ORR Growth Corridor

 

The G.O.Ms.No No 470 dated 09-07-2008 was issued notifying Special Development Regulations for 1 Km Belt on either side of the entire stretch of 162 Kms Outer Ring Road (ORR) – Hyderabad Outer Ring Road Growth Corridor (ORR-GC). These Regulations clearly sate that the restrictions imposed under the G.O.111, are applicable for the areas covered both under G.O.111& ORR-GC, regarding Building and Development activities. But unfortunately they are neither being observed in ORR-GC, nor being enforced by the concerned agencies

 

Draft Master Plan 2031

 

The draft Master Plan 2031 notified by HMDA, clearly states that the developments should take place in the area marked Bio-Conservation Zone only  in accordance with restrictions imposed under G.O.111. But unfortunately, more than 25% of the area marked Bio- Conservation Zone in the Draft Master Plan appears to have already been converted for other purposes either legally or illegally. This is being highlighted and brought to the notice of the authorities concerned, including Hon'ble Chief Ministers from time to time for about a decade. By the time, the draft Master Plan is finalized, there may be not be much of the area marked Bio-Conservation Zone, left.

 

Conclusion

 

 The painful and unpleasant conclusion is that the State Administration seems to have lost its credibility in the eyes of the Public, as it does not seem to be serious to implement the G.Os /Regulations / Rules issued. Firstly, the Delivery System at the grass roots level is insensitive, unresponsive and ineffective. Secondly, there is no Good Governance from Top to Bottom. And Thirdly, there are no independent Monitoring/ Regulating /Implementing Agencies, which can act and function without the interference of NETA/BABU nexus. Without these, Jan Lokpal Bill or No Bill, the Corruption will spread like cancer, harming the well being of the Nation

  1. Yes, it is painful to see people who violate the rules grossly stands to gain immensely; and other big losers.

    Also there is no clear summarized guidelines from HMDA of all GOs pertaining to bio-conservation resulting in some people getting duped by reality agents. Plus people always think that govt will relax the rule in future to their benefit, even if it is violated now.

  3. I have purchased in Ootpally shamshabad one plot after verification of 2002 HADA notice.But on 07.11.2011 zilla parishad declared cancelled the layout as unauthorised. How can it be.

  4. HADA Master Plan clearly states that no development activities will be permitted in the area marked Bio-Conservation Zone, which includes prohibited Area in Himayatsagar catchment.

    Ottapalli in Shamshabad Mandal is one of the villages in the prohibited catchment area of Himayatsagar as per G.O.111.

    There may not be any justification in support of your layout in Ottapalli village, which is probably based on wrong/misguided info

  7. I may not be able to advise, as I have no idea where Southern Mega Township is located. Please do not go by the advise of the agents or owners/ developers and decide. Please check with HMDA , if this Mega Township project has their approval and then decide.

    In Hyderabad there does not seem to be any problem about the Sale Deed.
    If there is a buyer, one can register a Sale Deed for Charminar ?

    My advise is, be cautious before you decide and check from the concerned agencies about the required approvals for the project.

  8. Southern mega township is just 3 KM far away from Shamshabad bus stand, and its close to ORR. There was an issue with venture owner in early 2000 but the PLOT owners approaches to HIGH COURT of AP, and this venture has developed under HighCourt of AP and most of the plots has also Auctioned by HC.

    As per Go 111, G+2 construction is allowed.

    1. Due to weak government and no major policy decision happening, GO111 reversion(not fully) could not took place. Once a strong decisive govt. forms there is going to be sea change in some areas definitely, say, shamshabad particularly.But expecting entire go111 reversion will not happen.Water bodies should be protected, even we loose our lands. Mother earth is supreme and should be treated with respect.

    It is very happy to see your immediate response to your blog readers and I do appreciate it. Let's leave the govt.and sales circuit actors a side. We all know that there is huge water problem in the catchment area and we also know that there are thousands of middle class people who bought lands over for their future generations. Though this doesn't seem to be a legal part from the legal and govt. end ( who encouraged and generated revenue of nearly 3cr. in 2006 & 07) now coming out with a fresh picture naming catchment area. I am very unhappy to convey you that there were many plastic industries that are mixing the polluted water in drinking ones and made it like a mini musi.
    Here I'm trying to convey you only one simple and logical issue. First govt. duty is to vacate the G.O because we are not living in AMERICA this is typical country who are more than 50% middle class people. Second, govt. need to find out an alternative because In world no country welcome to leave the crucial and business making area around world's top airport and for proving the in efficiency of govt. to supply the drinking water and remove the plastic companies over from there.. ? Every thing is possible but the only thing is MONEY.

    I do like to inform you politely that people who are fighting for the water are in parallel fighting to vacate the G.O. 111. Because as you said the "for the future of next generation... " really reaps when this G.O is vacated and get a justification to the money invested by them. This is not a GAME or a LEGAL INTELLIGENCE STAGE to discuss about the tentative intangible growth. Let's not encourage this and we are not ready to do soo...

Thank you for your feed back regarding G.O.111 controversy.If I have understood you correctly, you are one of those advocating supremacy of Economy over Environment, like our Prime Minister, ignoring the serious economic impacts of environmental problems caused by the so called economic development activities.

      In actual practice these environmental problems together with their economic impacts will be passed on to the future generations.

      If people want to, for the sake of MONEY, which is not every thing in life, encroach and pollute all the water bodies and convert all agriculture lands for other purpose, the present generation itself , leave alone the future generations,will reap the serious adverse consequences, as is being witnessed overcrowding of Cancer and other Hospitals ! I can only pray for them.

  10. i have a piece of ancestral property of around 3000SQ.yards at narsinghi village,rajendra nagar mandal which as per hmda is falling under WATER BODIES, but from last 3-4 decades water level of the kunta has not come to an extent of overflowing of water and my land is around 150meters from the katta of the kunta,

    kindly advise how can i develop my site in residential complex.

Sorry Ajay, for the delay in response due to over site..If your land is covered by the Full Tank Level (FTL) of the Kunta as per HMDA records you may not be able to change the land use irrespective of the fact of its ownership.If your land is around 150 Mtrs from the Katta of the Kunta, ie down stream as you put it, it may not form part of the water body. Please cross check from the village revenue records and approach HMDA for clarification

    1. Sorry , I may not be much of a help to clarify your point. Suggest that you approach the regional office of HMDA for Pattancheru area for confirmation regarding the Land Use of the land you intend purchase, as per HMDA Master Plan 2032

    I want to purchase a 500 sq yards plot in greenlands(manchirevula village). It is falling under ORR growth corridor special development zone. The layout is approved by gram panchayat and the plot is having LRS approval. Kindly advise if there will be any restrictions in future for building G+4. Kindly advise urgently.

    2. Sir, We have inquired about the ORR-GC at HMDA office. they have confirmed that the plot and the survey number are not on the growth corridor, But, the road will pass close by. Our only worry is if HMDA changes its plan and lay road through this survey numbers.

      Narsing is not advisable for residential use as it is in ORR Corridor.

  18. Sir what will be the fate of existing plot/land owners in ORRGC. Some of the layouts in ORRGC are very old and approved by panchayat. now how can the existing 25 feet road can be widened to 40' as per guidelines of HMDA. is it possible?

    First of all I want to thank you for this valuable information, it is sad to see corrupt authority has shown no interest in fixing this major problem to our beloved Hyderabad.

    I recently bought a land near Yenikepally(see map on link below), to build a G+2 house for my family. The property is about 7-8 Kms from ORR...I wanted to know if this area comes under any kind of restrictions and will there be any legal hurdles to do any construction in this area.

    Keep in mind there are already houses in this area, where people have moved and living for few years. I don't have any intention to build any commercial building here, it is solely for me and my family.

    We saw a plot(1250 sqrds) in manchirevulla villege and it is near by ORR, and It is 0.5 Km from ORR. We are staying out of India, so not sure about the Rules and Regulations in that area, but my uncle enquired and came to know there will be a road from Shaikpait to Manchirevula (125ft) over manchirevula vagu. But the broker is saying road will be atleast 65ft away from the plot.

    What are the building regulations over there? please provide us any links if possible.
    Could you please advice on this area.It will be really helpful.

    But after looking at some of the replies here, I was a bit confused if plots in this village are HMDA approved. Also the plot is sold by an individual owner than it being from a venture which i am doubting.

Also he is referring a news paper [ Telugu Shakshi news paper] article, Khanapur going to convert into municipality but from your post, it is not allowed to construct any residential construction.     1. Even if Khanapur becomes a Municipality , it continues to be in prohibited catchment area of the two water bodies and provisions of G.o.111 will be applicable.

      Please do not be mislead by News Paper and TV Ads and please avoid any property transactions in the villages covered by G..O.111.

    1. If the land is covered under G.O.111 there will be no time limit. The 2031 refers to HMDA Master Plan 2031 and it will have no bearing on provisions of G.O 111.The land under G.O.111 is full of issues and problems, please avoid going for it.

    I saw an AD for plots in Khanapur village (Survey No 228), as the developers said this survey number is converted to R1 Residential Zone. They have shown the HMDA letter (Land Use Information letter) confirming the same. I can send the scanned copy of the HDMA letter if you can provide your email id.

    1. As long as Osman Sagar & Himayat Sagar are relied upon to supply drinking water, it makes no difference whether the villages in the prohibited catchment area are in HMDA or GHMC ?
      The only way out is to abandon the two reservoirs as Drinking Water sources.

  29. Please check whether Kanakamamidi village is a hamlet of another village or Panchayat village by itself ?
    If it is a hamlet of one of the 84 villages in prohibited catchment area, HMDA is correct in showing it as bio-conservation zone.Otherwise please seek clarification from HMDA

    I have a general query. I wanted to buy a constructed house within panchayat limit with panachayat approval at Beeramguda, HYD. Do not have any LRS or HMDA/HUDA approval. As of now only 2 financial institutions provides loan for this house. Let me know what are the future problems that may arise or is it safe to buy this property. I have checked sale deed and encumbrance certificate and it is perfect.

    I am Uday working in Hyderabad. I want to but plot in kahanapur (S.No 227) . In HUDA master plan it's shown as R1 zone and current owner showing LAND USE from GHMC. All the related land documents are good but they are telling it's gram panchayat approved layout. I want to build home after 1-2 years. can u suggest me on this..

    I'm planning to purchase a plot at Adibatla near by TCS and ORR service road, which comes in ORR-GC and categorized as SDZ (Special Development Zone) in HMDA Master Plan.. I have seen your earlier comments regarding (G.O.Ms.No No 470 dated 09-07-2008) some restictions on this area.. but I don't understand exactly.. In this GO they clearly mentioned that it can be used for multiple purposes (Residential , commercial etc..) could you please let me know what are the problems with OOR-GC..

  35. As HMDA Master Plan lays down certain restrictions on development activities in Growth Corridor of ORR, please contact HMDA and get their clearance of any proposed activity in the Growth Corridor

    Good to see the you are helping many in creating awareness , i have a query from my side.
    Today i have seen a GP layout near ORR ( adibatla ) , the project is raghavendra homes by sri sai balaji developers with survey no as 34 and 35.

    As i have heard that there is some growth corridor zone In that area.

    Regarding this i have two queries

    - is this survey nos fall into growth corridor ? How to know about this and procedure for the same?

    - we have asked the builder he said it does not come under the same and he said the catchment under growth corrider can be used as either commercial or residential

    1. The Growth Corridor Zone, originally covered one KM on either side of ORR and all developments in this zone are subject to approval of HMDA. Please ask the Builder to show HMDA approval for the lay out .

    How many floors are allowed for a site of 500 sqyds in ORR-GC. The site has 40ft road but falls under 1km range of ORR (inside city).

    I intend to buy a plot in khanapur,Rajendra Nagar Mandal, RR Dist, Survey .No 228, in master plan it's shown as R1 (Residential Zone) zone and its a gram panchayat approved layout. After buying I intend to construct house immediately. Kindly provide your valuable advice on this land. pl advice

    1. Sorry for the delay in my response. As Khanapur is one of the 84 Prohibited Villages as per G.O.111. no development activity is permitted as per AP Court Directive. Panchayat is not authorised to approve any layouts in Prohibited area which is notified as Conservation Zone by HMDA. Please verify from HMDA regarding the authenticity of the layout.

    Could you please let me now whether the layouts/individual houses being constructed 15 ms away from ORR road- service road should have HMDA approval. Or only enforcing authority of panchayath executive officer is enough to give the permission ?

    1. As these two villages are in prohibited catchment area as per G.O.111 which are notified as Conservation Zone, please do not go in for them without cross checking from HMDA

    Iam planning to purchase a piece of land (1100 Sq Yards) in “Dream valley peacock homes” venture falling under survey # 363,364,366,370,371 of Srinagar, Manchirevula village, Ranjendra nagar mandal. There is a big gated community being planned by a premier construction company right besides this venture and it is being propagated that “Dream valley peacock venture” falls under some zone, where construction is prohibited. The land which I am proposing to buy is backed by all relevant documents and has LRS as well. But still not sure if I have to go ahead with the purchase! Wanted to get your thoughts on this venture if you have made any observations about the venture and the locality.

    1. Sorry for the delay in my response. Manchirevula village of Rajendra Nagar Mandal is not covered by the list of 84 prohibited Villages of G.O.111.Please make sure that the layout of “Dream Valley Peacock Homes” in which you plan to buy the plot, is approved by HMDA.

  46. Hello Rama Rao ji, I am planning to buy a plot in Khanapur / Vattinagullapally along the ORR which is situated at Survey No 273/A, 273/E. As per your previous comments I understand that vattinagullapally/Khanapur comes under prohibited catchment area as per G.O.111 and you have suggested to contact HMDA for further details. Can you please guide me if I need to go to HMDA patancheru office personally or I can find out the details online. Any information will be very helpful.

Sorry for the delay in my response.Khanapur and Vattinagulapally are covered by G.O.111 and no development activity is permitted as directed by AP High Court and Govt of AP Circular issued on the subject.But still development activities continue to take place which are risky.Please keep away if you want to be law-abiding and do not want to take risks.

    I have purchased 500 sq.yds. land in Adibatla, Metrocity Infra Developers - Phase2 which comes under survey no.s: 158 and 159 in Adibatla. Some resources saying that there will be a proposed 80 feet road which connects Adibatla village with ORR and this 80 feet road will go in the center of our layout. We are not sure which plots are going to affect. Please let us know if you have any information or suggestions on this. We have applied for LRS.

    I purchased some agriculture piece of land in Pocharam village, Ghatkeskar mandal way back in 1982, now I have applied for LRS and they have sent me a shortfall notice that I should provide them with a revenue sketch from the MRO office as a 60 meters road is going to go through the survey where my land is located.
    The MRO says he cannot provide it as he has no records of it.
    Is it not the responsibility of the Planning office to provide the information whether the supposed 60 mtrs road is passing through my piece of land?
